O Peso do Argumento

Ricardo Matos entrou no tribunal com os seus documentos organizados em pastas numeradas, cada uma correspondendo a um argumento que preparara ao longo de três semanas. Era um advogado meticuloso, formado com distinção em Coimbra, e acreditava — com a convicção ingénua de quem ainda não fora suficientemente derrotado — que argumentar com clareza e provas era suficiente para fazer a justiça prevalecer. O seu cliente, um operário têxtil de cinquenta e dois anos despedido ilegalmente após vinte e um anos de serviço, sentava-se atrás dele em silêncio.

Ricardo Matos entered the courtroom with his documents organised in numbered folders, each corresponding to an argument he had prepared over three weeks. He was a meticulous lawyer, graduated with distinction from Coimbra, and believed — with the naïve conviction of someone not yet sufficiently defeated — that arguing with clarity and evidence was sufficient to make justice prevail. His client, a fifty-two-year-old textile worker unlawfully dismissed after twenty-one years of service, sat behind him in silence.

O caso parecia sólido. A empresa havia argumentado que o despedimento se devia a necessidades de reestruturação, mas Ricardo tinha documentos que demonstravam que outro trabalhador com menos antiguidade fora contratado dois meses depois para funções idênticas. Argumentara esta contradição perante o tribunal do trabalho em primeira instância, e ganhara. A empresa recorreu. Agora estavam no tribunal da relação, e as regras eram outras.

The case seemed solid. The company had argued that the dismissal was due to restructuring needs, but Ricardo had documents showing that another worker with less seniority had been hired two months later for identical duties. He had argued this contradiction before the labour court at first instance, and won. The company appealed. Now they were at the court of appeal, and the rules were different.

The company's lawyer, a man in a grey suit with impeccably combed hair, argued with the fluency of someone who knows that time and fees are on his side. He cited case law, invoked European precedents, and argued that the new worker's contract had a slightly different technical designation — a difference sufficient, he maintained, to render the comparison invalid.

— Com o devido respeito pelo tribunal — argumentou Ricardo, levantando-se —, a diferença de designação é uma ficção administrativa criada a posteriori. O conteúdo funcional é idêntico, como demonstram as fichas de posto de trabalho que juntei como documento dezassete. Argumentar que uma etiqueta diferente transforma funções iguais em funções distintas é um exercício de formalismo que contradiz o espírito da lei laboral.

"With all due respect to the court," Ricardo argued, rising to his feet, "the difference in designation is an administrative fiction created after the fact. The functional content is identical, as demonstrated by the job description forms I submitted as document seventeen. To argue that a different label transforms identical duties into distinct ones is an exercise in formalism that contradicts the spirit of labour law."

O juiz desembargador ouviu com a expressão neutra que Ricardo já aprendera a temer — aquela que não revelava nem simpatia nem rejeição, apenas a distância profissional de quem processava argumentos como se fossem peças de xadrez numa partida que ele não precisava de ganhar pessoalmente.

The appeal court judge listened with the neutral expression Ricardo had already learned to dread — the one that revealed neither sympathy nor rejection, only the professional distance of someone processing arguments as though they were chess pieces in a game he did not need to win personally.

No intervalo, o seu cliente, Manuel, aproximou-se no corredor. — O senhor doutor acha que vamos ganhar? — perguntou, com a voz de quem temia a resposta. Ricardo argumentara com Manuel, no início do processo, que o caso era forte. Agora, meses depois, sentia o peso de ter criado expectativas que talvez não pudesse cumprir.

During the recess, his client, Manuel, approached him in the corridor. "Do you think we'll win?" he asked, with the voice of someone who feared the answer. Ricardo had argued with Manuel at the start of the case that it was strong. Now, months later, he felt the weight of having created expectations he might not be able to fulfil.

— Argumentámos bem. As provas são sólidas. Mas a verdade é que neste tribunal os argumentos técnicos têm tanto peso quanto a composição do colectivo — disse Ricardo, em voz baixa. — E isso não está nas nossas mãos.

"We have argued well. The evidence is solid. But the truth is that in this court, technical arguments carry as much weight as the composition of the panel," Ricardo said, in a low voice. "And that is not in our hands."

A sentença chegou três semanas depois, por escrito, como era costume naquele tribunal. A empresa ganhara por dois votos contra um. O acórdão reconhecia a solidez dos argumentos de Ricardo, mas concluía que, "na margem de interpretação permitida pela lei", a distinção contratual era suficiente para justificar o despedimento. A voz dissidente do terceiro juiz argumentava em sentido contrário com uma lucidez que Ricardo releu várias vezes.

The sentence came three weeks later, in writing, as was custom in that court. The company had won by two votes to one. The ruling acknowledged the soundness of Ricardo's arguments, but concluded that, "within the margin of interpretation permitted by the law", the contractual distinction was sufficient to justify the dismissal. The dissenting voice of the third judge argued in the contrary direction with a lucidity that Ricardo reread several times.

Telefonou a Manuel nessa tarde. Não havia palavras adequadas para este momento; havia apenas a obrigação de ser claro. — Perdemos. Mas não porque os nossos argumentos fossem fracos. Existe uma diferença entre argumentar bem e ganhar, e hoje aprendemos isso da pior maneira.

He called Manuel that afternoon. There were no adequate words for this moment; there was only the obligation to be clear. "We lost. But not because our arguments were weak. There is a difference between arguing well and winning, and today we learned that the hard way."

Manuel ficou em silêncio por um longo momento. — E agora? — O Supremo Tribunal Administrativo — disse Ricardo. — Vou argumentar lá também. Enquanto houver instâncias, argumentarei.

Manuel was silent for a long moment. "And now?" "The Supreme Administrative Court," said Ricardo. "I will argue there too. As long as there are instances, I will argue."

Era uma promessa que Ricardo sabia poder não cumprir em termos de resultado, mas que podia cumprir em termos de esforço. E havia uma distinção importante entre as duas coisas — uma distinção que o direito tendia a ignorar, mas que a ética não permitia esquecer. Argumentar não era garantir. Era, no entanto, a única coisa honesta que podia fazer.

It was a promise Ricardo knew he might not be able to keep in terms of outcome, but could keep in terms of effort. And there was an important distinction between the two — a distinction that the law tended to ignore, but that ethics would not allow to be forgotten. To argue was not to guarantee. It was, however, the only honest thing he could do.

De regresso a casa nessa noite, Ricardo abriu o caderno onde registava as suas notas pessoais sobre os casos. Escreveu apenas uma frase: "Argumentei tudo o que havia para argumentar. O problema não era o argumento." Fechou o caderno, apagou a luz, e começou a preparar o recurso para o Supremo.

On his way home that night, Ricardo opened the notebook where he kept personal notes on his cases. He wrote just one sentence: "I argued everything there was to argue. The problem was not the argument." He closed the notebook, turned off the light, and began preparing the appeal to the Supreme Court.
