Quarenta anos a discernir. Era assim que o juiz António Rodrigues resumia a sua carreira quando alguém lhe perguntava — não por modéstia, mas porque era a descrição mais exata que encontrava. Discernira entre o culpado e o inocente, entre a verdade e a mera verosimilhança, entre a letra da lei e o espírito que lhe dera origem. Reformado há dois anos, escrevia agora as suas memórias num quarto com vista para o Douro, num tom que não era o do magistrado que pronuncia sentenças mas o de alguém que discerne, pela última vez, a sua própria experiência. A primeira frase do livro era: "Discernir não é uma ciência. É uma virtude que se cultiva com humildade e que se perde, silenciosamente, com a arrogância."

Forty years of discerning. That was how Judge António Rodrigues summarised his career when someone asked him — not out of modesty, but because it was the most precise description he could find. He had discerned between the guilty and the innocent, between truth and mere verisimilitude, between the letter of the law and the spirit that had given rise to it. Retired for two years, he was now writing his memoirs in a room overlooking the Douro, in a register not of the magistrate who pronounces verdicts but of someone discerning, for the last time, his own experience. The first sentence of the book was: "Discerning is not a science. It is a virtue cultivated with humility and lost, silently, with arrogance."

O caso que mais o marcara envolvia uma mulher que admitiu, sem hesitar, ter cometido um crime menor para proteger o filho de uma situação de violência doméstica. A lei era clara; a sentença que ela exigia, tecnicamente, também. António discernira entre as normas aplicáveis e aplicara-as, como era o seu dever. Mas durante os anos seguintes continuou a voltar àquele rosto na sala do tribunal — a clareza com que ela o olhara, sem súplica, apenas com a serenidade de quem sabe que fez o que tinha de fazer. Discernira corretamente segundo a lei. Mas discernira com justiça? A pergunta não o largou. A justiça, compreendeu com o tempo, não é apenas a aplicação fiel de normas: exige que discernamos o contexto humano que as normas, por definição, nunca conseguem capturar na sua totalidade.

The case that had marked him most involved a woman who admitted, without hesitation, to having committed a minor crime to protect her son from a situation of domestic violence. The law was clear; the sentence it demanded, technically, also. António had discerned among the applicable norms and applied them, as was his duty. But in the years that followed he kept returning to that face in the courtroom — the clarity with which she had looked at him, without supplication, only with the serenity of someone who knows they did what they had to do. Had he discerned correctly according to the law? Yes. But had he discerned with justice? The question never left him. Justice, he came to understand over time, is not merely the faithful application of norms: it requires us to discern the human context that norms, by definition, can never fully capture.

Nas últimas páginas das suas memórias, António escreveu demorada e cuidadosamente sobre aquilo que considerava a lição mais difícil de toda a sua vida — mais difícil do que qualquer caso, do que qualquer sentença: discernir os limites do próprio discernimento. Saber quando não sabemos — aceitar a opacidade irredutível da nossa própria perceção, a forma como os nossos ângulos cegos nos acompanham invisíveis até ao momento em que alguém os ilumina — é, paradoxalmente, a expressão mais elevada do discernimento humano. Não a certeza, mas a lucidez sobre a sua ausência. Terminou o livro com a única pergunta que passara quarenta anos a tentar responder e que permanecia, intacta, sem resposta: "Como discernir com justiça quando somos, nós próprios, criaturas imperfeitas que discernem?"

In the final pages of his memoirs, António wrote slowly and carefully about what he considered the hardest lesson of his entire life — harder than any case, than any verdict: discerning the limits of one's own discernment. Knowing when we do not know — accepting the irreducible opacity of our own perception, the way our blind spots accompany us invisibly until someone illuminates them — is, paradoxically, the highest expression of human discernment. Not certainty, but lucidity about its absence. He ended the book with the only question he had spent forty years attempting to answer and which remained, intact, unanswered: "How do we discern with justice when we ourselves are imperfect creatures who discern?"
