Dr Carmo Esteves has sixteen years of criminal law practice and a reputation built on a simple principle: everyone deserves a defence. It does not matter what the crime is. It does not matter who the defendant is. A fair defence is the cornerstone of the rule of law. It is what she tells her clients, her trainees and herself when the difficult cases arrive.

O cliente chama-se Rui Machado. É acusado de fraude financeira — desviou, segundo a acusação, trezentos mil euros de uma associação de solidariedade onde trabalhava como contabilista. A Dra. Carmo aceita o caso porque Rui insiste que é inocente, porque a investigação policial parece apressada e porque há lacunas reais no processo da acusação.

The client's name is Rui Machado. He is accused of financial fraud — he allegedly diverted, according to the prosecution, three hundred thousand euros from a solidarity association where he worked as an accountant. Dr Carmo accepts the case because Rui insists he is innocent, because the police investigation seems rushed and because there are real gaps in the prosecution's case.

No quarto dia de julgamento, a acusação apresenta um documento que a Dra. Carmo não conhecia: um extracto bancário de uma conta offshore em nome de um familiar de Rui. O valor corresponde exactamente ao montante desviado. A Dra. Carmo pede uma suspensão e confronta Rui na sala de reuniões. Ele hesita meio segundo de mais. "Mentiste-me," diz ela, baixinho. "Todo este tempo, mentiste-me."

On the fourth day of the trial, the prosecution presents a document that Dr Carmo did not know about: a bank statement for an offshore account in the name of a relative of Rui. The amount corresponds exactly to the diverted sum. Dr Carmo requests a recess and confronts Rui in the meeting room. He hesitates half a second too long. "You lied to me," she says quietly. "All this time, you lied to me."

A situação é tecnicamente clara, mas eticamente devastadora. Um advogado não pode revelar as confissões do cliente — isso é segredo profissional absoluto. Mas também não pode continuar a apresentar como verdade aquilo que sabe ser falso. A Dra. Carmo conhece a saída: tem o direito de se retirar do caso, desde que não revele o motivo. É legal. É ético. É também uma derrota.

The situation is technically clear but ethically devastating. A lawyer cannot reveal a client's confessions — that is absolute professional privilege. But she cannot continue to present as true what she knows to be false. Dr Carmo knows the way out: she has the right to withdraw from the case, as long as she does not reveal the reason. It is legal. It is ethical. It is also a defeat.

No dia seguinte, a Dra. Carmo informa o tribunal que se retira da defesa por razões pessoais, sem mais detalhes. O juiz aceita. Rui fica a olhar para ela enquanto ela recoge os seus papéis. Ela não lhe devolve o olhar. Na rua, o seu estagiário pergunta-lhe o que aconteceu. "Às vezes," diz ela, "o trabalho mais difícil não é defender. É saber quando parar."

The following day, Dr Carmo informs the court that she is withdrawing from the defence for personal reasons, without further detail. The judge accepts. Rui stares at her as she gathers her papers. She does not meet his gaze. In the street, her trainee asks her what happened. "Sometimes," she says, "the hardest work is not defending. It is knowing when to stop."

Três meses depois, Rui Machado é condenado pelo novo advogado que contratou. A Dra. Carmo lê a notícia no jornal. Não sente satisfação nem alívio. Sente apenas o peso de um sistema que funciona — mas que obriga os seus operadores a carregar sozinhos com as contradições que ele próprio não consegue resolver.

Three months later, Rui Machado is convicted by the new lawyer he hired. Dr Carmo reads the news in the newspaper. She feels neither satisfaction nor relief. She feels only the weight of a system that works — but that forces its operators to carry alone the contradictions that it itself cannot resolve.
